Court sides with Apple; iPhone 5, iPad 3 to be kept secret

The back and forth between Samsung and Apple continues. After being sued by Apple for copying the overall design and feel of the iPhone, Samsung was forced to hand over its latest devices for inspection. A week later, Samsung responded with a request to see Apple’s next generation products (iPhone 5 and iPad 3), claiming these would be the devices Samsung competes against. Having such products would help Samsung prepare against any type of legal action from Apple.

As we expected, Apple was not happy about this request and was very unwilling to cooperate. We’ve just found out the Court agrees; Apple will not need to hand over the iPhone 5 or iPad3. This decision is based mainly on already-known reasons, including the fact that Apple has not announced either device and that Apple tends to be very secretive.

While Samsung is probably right about that Apple will soon release the iPhone 5, it’s still considered a company secret. Nothing is known of these devices. Apple claims Samsung is basing their request on an assumption.

The Court has definitely sided with Apple in this part of the fight. But to keep things fair, the Court is considering Samsung’s arguments. No action is to be taken–at least not yet. The Court acknowledges Samsung could very well argue its new devices will be competing with the nest generation of Apple devices, not the current ones.

Samsung is free to argue, for instance, that there is little likelihood of confusion because consumers will not encounter its products side-by-side with the iPhone 4 or iPad 2, but rather with Appleā€™s next generation iPhone and iPad. Similarly, as to proximity, Samsung is free to argue that because the iPhone 4 and iPad 2 will soon be outmoded and reduced in price, they are not being sold (or very soon will not be sold) to the same class of purchasers who are likely to buy new Samsung products. Stay tuned for more details, as it may take a long time for things to be resolved (lawsuits usually do). For now, Samsung will not be getting dibs on any Apple devices. The whole case could very well be put on hold, as things might have to wait until Apple’s products are announced/released and a better judgement can rendered. Do you guys think Samsung will ask the Court to wait until the iDevices come around? Is it even fair to state Samsung devices (Galaxy Tab 10.1, Galaxy Tab 8.9, Galaxy S II, Infuse 4G, and Droid Charge) are more directly competing with future Apple devices instead of current ones?     IMO Samsung should start designing things that DON’T resemble Apple products. I don’t care how fast your phone is if every time I have it in public someone says, look at that phoney iphone. HTC has the right idea.

      iOS 5 ripped off so many things from Android and WebOS.
      Iphone was a rip off of LG and Samsung all touchscreen phone released a year before the iphone.
      iPad is a rip off of many PC all touch tablets. Some released as early as 2002.
      iOS in general is a rip off of Palm’s UI and other UI’s that were around before ios.

      You really got it wrong. Apple is nowhere near the first one who came up with that design.

      Samsung and the rest have been in the smartphone business for way longer than Apple. Just because it’s famous doesn’t mean it came up with the idea.

    Samsung needs to worry about their own devices and not what Apple is up to. Keep your eye on the ball Samsung and take care of your own problems first ( like updating your phones, for one). Love Samsung t.v.’s but I will keep my HTC. Soon, getting the Evo 3D friday. AWESOME.

    Screw apple.im glad they dont make cars.alot of cars look alot alike and have the same features.if apple owned a auto company apple motors would sue ford for door handles and wiper blades.they need to quit thier bs and make good enough products to where consumers actualy want thier icrap.

    Just another ploy by apple to keep from losing even more consumers. While they take the good ideas from Google and implement them in to there products. Should be fun to watch, apple is use to suing company’s with less cash then them,so they can bully there way to what they want. They didn’t invent the smart phone,or touch screen, or even the iPhone name. They just have a lot of sheep to buy there products.

    Trust me Apple wish they can intimidate HTC that will never happen. Apple is definately something that would have no use in my world. I feel sorry for those that feel the need to have to have anything Apple. Apple had there time that has past homage has already been paid for what they brought to the table now others players are leading technology.     Apple has to sue people first so that they can turn to their iSheep and say, “Look! Look! We’re such innovators that people are trying to copy us!” Then the uninformed public will believe Apple invented every new technology.

    Apple is running scared because the iPhone 5 has been already made obsolete by the SGS2.

    Apple has its place, but it’s no longer at the front of the pack when it comes to mobile devices.

    If I were Samsung and faced with the court order to present my product to Apple for review, I would quickly do a mock-up only distantly resembling the actual product and say that yes, the product is announced, but is not yet fully finished, so here is how we currently see it – but it may change (drastically!) when it is available in stores. I have to right to change appearance/functionality of my products whenever I want to, if I am able to do so on a short notice.

    That way Apple gets sh!t from me.
